Membership Waiver and Release Liability Form
In consideration of the risk of injury while participating in pottery activities (the “Activities”), and as consideration for the right to participate, I, for myself and for my heirs, executors, administrators, assigns, and personal representatives, knowingly and voluntarily enter into this Waiver and Release of Liability. I hereby waive any and all rights, claims, or causes of action of any kind arising out of my participation in the Activities, and I release and forever discharge Clayroom Denver, Inc., located at 1553 Platte Street, Unit C100, Denver, CO 80202, and its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, from any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economic or emotional loss, that I may suffer as a direct or indirect result of my participation in the Activities, including travel to and from any related event.
I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES AND I AM PARTICIPATING ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM, AS WELL AS PARTICIPATING IN, THE ACTIVITIES, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, KNOWN OR UNKNOWN, OF MY PARTICIPATION IN THE ACTIVITIES, INCLUDING TRAVEL TO, FROM, AND DURING THE ACTIVITIES.
I agree to indemnify and hold harmless Clayroom Denver, Inc. from and against any and all claims, suits, or actions of any kind for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorneys’ fees and related costs, if litigation arises from any claims made by me or by anyone acting on my behalf. If Clayroom Denver, Inc. incurs any such expenses, I agree to reimburse Clayroom Denver, Inc..
I acknowledge that Clayroom Denver, Inc. and its directors, officers, volunteers, representatives, and agents are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting any specific event or activity on behalf of Clayroom Denver, Inc..
I ACKNOWLEDGE THAT THE ACTIVITIES MAY TEST A PERSON’S PHYSICAL AND MENTAL LIMITS AND MAY CARRY THE POTENTIAL FOR DEATH, SERIOUS INJURY, AND PROPERTY LOSS. Risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic, and the actions of others (including participants, volunteers, spectators, coaches, event officials, event monitors, and producers).
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE CLAYROOM DENVER, INC., AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS, AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION, AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST CLAYROOM DENVER, INC. FOR PERSONAL INJURY OR PROPERTY DAMAGE.
To the extent that statute or case law does not prohibit releases for negligence, this release also applies to negligence on the part of Clayroom Denver, Inc., its agents, and employees.
If I require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I understand that I should carry my own health insurance.
If any damage to equipment or facilities occurs as a result of my or my family’s willful actions, neglect, or recklessness, I agree to be liable for all associated costs.
This Agreement is entered into at arm’s length, without duress or coercion, and is to be interpreted as an agreement between parties of equal bargaining strength. Both the Participant, __________________________, and Clayroom Denver, Inc. agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain its terms. It will be interpreted based solely on its language and the purposes for which it is entered into.
If any provision of this Release of Liability is deemed severable or invalid, or if any term, condition, phrase, or portion is determined to be unlawful or otherwise unenforceable, the remainder shall remain in full force and effect, so long as the severed clause does not affect the intent of the parties. If a court finds any provision invalid or unenforceable, but that by limiting the provision it would become valid and enforceable, then it shall be written, construed, and enforced as so limited.
Standard Membership Policies
Eligibility & Orientation

Members must be 18+, able to work independently, and have an intermediate level of ceramics experience.

Orientation is required before membership begins. Orientation includes a studio walkthrough and setup of your Yale door access.
Conduct & Safety

All members are expected to conduct themselves professionally and respectfully.

No smoking in the studio or within 25 feet of the entrance or garage door.

No unlawful controlled substances on the premises.
-
No dry sanding. Sanding pads can be obtained through a staff member.
Studio Access
-
Access credentials are for the assigned member only. Do not share app access or allow entry to non members outside of approved guest times.
Classroom areas
-
When classes are scheduled, priority of certain wheels and/or handbuilding tables may be given to students. During this time, members may still use designated member wheel and work table areas.
Cleaning Standards
Members are responsible for cleaning all equipment and areas they use and for keeping shelves sanitary, including regular trash removal.
Cleaning includes:

Wiping all used surfaces so no clay or material remains.

Mopping the floor directly around your work area.
-
Returning items and materials to their designated locations.
-
Wiping boards and returning them to board storage.
-
Rinsing communal tools so no clay remains on them.

Placing any hand-removable clay scraps/slop into the reclaim bin (no water). Sinks are for final rinses only; do not overload clay traps.

Storing clay in designated member clay areas and disposing of related trash (including dried clay and empty bags).

Any tools, equipment, or pots with glaze to be removed must be rinsed in the glaze rinse buckets, not the sink, so excess can be reclaimed.
Non-compliance with cleaning policies may result in denial of membership renewal.
Studio Etiquette

Phone calls: Please take calls outside the studio to avoid disrupting others.

Equipment use: If you are unsure how to operate any equipment, ask staff first to avoid damage.
Tools, Materials & Glazes

Basic studio tools are available for occasional use, but supply may be limited during classes. Members are encouraged to bring their own tools. Return any studio tools clean and intact; excessive damage or loss may be billed at replacement cost.

Non-studio glazes: Consult staff before using any glazes not provided by the studio. Test tiles are typically required. Clayroom reserves the right to forbid unauthorized glazes.
Clay, Reclaim & Firing

Clay purchases: Members must purchase clay from Clayroom at market price + $20 firing fee per 25-lb bag. No exceptions. If there’s a clay you’d like us to carry, speak with staff and we’ll explore adding it.

Reclaim: Place clay scraps (no water) into reclaim bins; pieces must fit through the lid grate. No bisque in reclaim.

Firing fees: $20 per 25-lb bag of clay (covers standard bisque and glaze firings).

All pieces must be labeled with your name or makers mark, bottoms wiped clean or placed on a cookie if glaze is near the foot. Staff may refuse to fire work that is too thick or improperly applied.

Do not fire anything that isn't yours unless it is on the free / test tile shelf. Do not fire cement, resin, or metal lusters without written approval.

Members are responsible for damage caused by their work. Fees may include shelf grinding or replacement, kiln wash, element contamination, and load loss where applicable.
Dogs
-
Friendly dogs are welcome. Handlers are responsible for leashes, behavior, and cleanup. We may ask you to remove a dog that is disruptive or unsafe. Please keep dogs away from kiln area.
Personal Property

Clayroom is not responsible for the security of members’ property on the premises. Members waive any claimsfor loss due to theft or damage.
Guests
-
Guests are permitted only during designated member nights, with prior staff approval. Members are responsible for guest conduct.
Billing & Cancellations
-
Memberships start on the 1st or the 15th; dues are collected on that date unless otherwise arranged in writing.

Cancellation: Provide notice at least two weeks before the 1st of the month; otherwise, you will be billed for the subsequent month.

Payment is due on the billing date. If a payment fails, you have a 3-day grace period; after that, a late fee of $15 may apply and studio access may be suspended until payment is resolved. We do not prorate partial months unless arranged in writing prior to the billing date. Membership changes (upgrade/downgrade) take effect on the next billing date.
Shelf Sublets

Memberships cannot be paused.

If you will be away for about a month, you may request to sublet your shelf to a pre-approved community member. Sublets require prior staff approval, orientation, and a signed waiver. The original member remains responsible for dues and any damages. We provide a sign-up sheet to help match dates.
Photo and Communications

We may photograph events for studio communications. We will ask before taking photos, but if you prefer not to be photographed, just let us know!
Emergency and incident reporting

First aid boxes are kept in the studio at all times and are available for anyone at anytime. In an emergency, call 911 and notify staff. Report any injury, breakage, or unsafe condition to staff or by emailing hello@denverclayroom.com after business hours.
Policy Changes
-
Policies may change with five days’ notice. Members agree to comply with updated policies.
